General Terms and Conditions
Standard terms and conditions of delivery and payment for greenhouse accessories
1. Please use the online order form for your order, send us an e-mail, a fax, or give us a call.
2. If the contract value is equal to or exceeds 150.00 EUR, the shipment - including costs for postage and packaging – will be ‘free at domicile’ within the Federal Republic of Germany (does not apply to hollow-design boards).
3. If the contract value is less than 150.00 EUR, costs for postage and packaging will amount to 5.25 EUR for shipments within the Federal Republic of Germany (does not apply to hollow-design boards).
4. If the contract value is less than 15.00 EUR, we charge 5.25 EUR for postage and packaging and additionally a minimum quantity price supplement of 3.00 EUR.
5. The shipment will be carried out via postal services, DHL or a shipping agency. Each shipment is covered by a shipping insurance.
6. If your order was damaged in postal shipping, this damage must be reported and recorded immediately / within 7 days at the responsible post branch office. In the case of a shipping deterioration in transit, we need the waybill including the damage confirmation by the driver within 4 days.
7. Deficiencies of the delivered goods must be reported in writing within 2 weeks upon delivery. This does not apply to latent defects, however.
8. Prices are final prices. We reserve the right of design and price adjustments. Please select one of the five modes of payment:

The one-time direct debit authorization is only valid for the respective order.

9. All prices are inclusive of applicable VAT (19 %). VAT will be indicated on the invoice separately.
10. We reserve the right of ownership of the goods pending full payment of the purchase price.
11. Our delivery times are ca 3 to 4 working days or according agreement. Sale and shipping of our goods ex Bielefeld/Germany exclusively.
Withdrawal instructions
12. Right of withdrawal
You have the right to withdraw your contract declaration in written form (e.g. letter, fax, e-mail) within a period of one month without stating your reasons or by returning the goods. The term begins at the earliest with the reception of this instruction. For adherence to the term of withdrawal, the timely sending of your cancellation (or of the goods) is sufficient. Withdrawal consequences (only required if the services on both sides have been received prior to term of withdrawal):
In the case of a withdrawal, the services received on both sides shall be returned and possible benefits thereof (e.g. interests) shall be surrendered. If the received services cannot be refunded totally or partly or only in worsened condition, you must carry the cost to the extent of reduced value. This does not apply in the case of the cession of goods, if the worsened condition of the goods is solely due to inspecting them, as would be possible in a retail shop. The obligation to pay compensation can be avoided by not using the goods as an owner would, and by refraining from actions causing their value to be impaired. In the case of goods, which can be sent by parcel mail, the goods shall be shipped at our costs and risks. Goods, which cannot sent by parcel mail, shall be collected at the buyer's. In the case of returning goods pertaining to a delivery of goods with a contractual value up to 40.00 EUR, you must carry the shipping costs yourself, if the delivered goods correspond to the ordered goods. Otherwise, the return of goods is cost-free for you.
Special notes:
Your right of withdrawal expires prematurely, if your contractual partner has begun with the performance of service with your explicit consent before the expiration of the period of withdrawal, or if you have authorized this yourself (e.g. by downloads, etc.).

13. Right of return
You have the right to return the goods within a period of one month without stating your reasons by returning the goods. The term begins at the earliest with the reception of the goods and of this instruction. Only in the case of goods, which cannot be sent by parcel mail (e.g. bulky goods), you have the right to state your wish to return goods in written form, i.e. by letter, fax, or e-mail. For adherence to the term of return, the timely sending of the goods or of your wish to return the goods is sufficient. In the case of returning the goods, we shall bear the risks and costs of return. The return or the wish to return is to be sent to:

14. Return consequences
In the case of a valid cancellation, the services received on both sides shall be returned and possible benefits thereof (e.g. interests) shall be surrendered. If the goods are not in pristine condition, we may claim compensation for loss of value. This does not apply, if the worsened condition of the goods is solely due to inspecting them, as would be possible in a retail shop. As for the rest, you can avoid the obligation to pay compensation by not using the goods as an owner would, and by refraining from actions that would cause their value to be impaired.

15. If returning goods that have been paid, return of payment shall be carried out via bank transfer (orders of 40.00 EUR and more incl. costs for postage and packaging). Please state bank address, BLZ (bank identification code), and account number.
16. Notes regarding the forwarding to foreign countries:
Each article offered in this shop (exceptions: bubble insulating film and hollow-design boards) will be shipped via DHL/GLS to the following countries:

For orders from Austria, Switzerland, Netherlands, Belgium and United Kingdom, the payment via immediate payment is additionally possible.
17. It is agreed that Bielefeld shall be the place of delivery and payment. Exclusive place of jurisdiction as agreed shall be Bielefeld for both parties, if the customer is general merchant.
18. German laws shall apply for this contract and the entire legal relationship of both parties, excluding application of the UN Convention on Contracts for the International Sale of Goods (CISG). Should the individual conditions of this contract be or become ineffective in any of its points, this shall not affect the validity of the remaining points.
19. No caution without previously establishing contact!
Should the content or the presentation of these pages violate or infringe upon the rights of any third party or any laws or governmental regulations, we ask you to send us a message without bill or note of costs. We guarantee that the passages queried rightly are immediately changed or removed, without the necessity from your side to intercalate a legal adviser. However, released costs without previous establishment of contact are rejected at full extent and release – if necessary – a counter suit because of injury of aforementioned regulations.
